“Rachelle’s Lab Owned Content” means, to the extent it is protected copyright work, and is not expressly marked as “Other Content”, all or any part of any text, image, video or any other type of media in any format contained and comprised in the Website. “Rachelle’s Lab Owned Content” does not include the content created by members other than the owner of the Website in the “Forum.”
“Other Content” means all or any part of any text, image, video or any other type of media in any format contained and comprised in the Website and expressly marked as the copyright property of a third party, property in public domain, or property in open access databases.
“Forum” means any all or any part of any text, image, video or any other type of media in any format contained and comprised in “Forum 稷下” (rachelleslab.com/forum).
“You” means any person who books a service via the Website, views or subscribes to the Website and/or participates in discussion in the Forum at rachelleslab.com/forum.

1. Copyright

1.1 The Chinese texts and images used on the Website are either from the public domain (e.g. Wikipedia), databases with open data licences (e.g. Shuhua diancang ziliao jiansuo xitong 書畫典藏資料檢索系統, National Palace Museum, Taipei), online libraries that permit reasonable use (e.g. ctext.org), or original work created for the Website.

The Website and Rachelle’s Lab Owned Content (including but not limited to translations, blog posts, images, videos, etc.) are protected under international copyright law.

1.2 Permission is granted for fair use of Rachelle’s Lab Owned Content for private non-commercial purposes. You may:

download, save, and print any pages of the Website for your own private use;
download, save, and print any pages of the Website for non-profit academic use only, on the condition that you credit Rachelle’s Lab whenever using them;
quote reasonable amounts of Rachelle’s Lab Owned Content for illustrative purposes, on the condition that you credit Rachelle’s Lab whenever using them.

1.3 If you wish to republish or make derivative work based on Rachelle’s Lab Owned Content, please write to contact.rachelleslab@gmail.com to get written permission first and make sure to credit Rachelle’s Lab whenever using its content.

1.4 If you wish to use Rachelle’s Lab Owned Content for any other purposes, including commercial purposes, please write to contact.rachelleslab@gmail.com to get written permission first.

1.5 In the Forum, Rachelle’s Lab only owns the copyright of the content created by the owner of the Website and does not own the copyright of any content created by other members of the Forum. If you wish to make use of any such content, please contact the member who creates it.

1.6 Rachelle’s Lab has made reasonable efforts to provide links to external resources freely available to the public and to identify any content in which a third party owns copyright. It is your responsibility to check out the copyright of Other Content and secure any permission or consent required for your own use of any content in which a third party owns copyright. 2. Cancellation and Refund Policy

21. Private Tutorials

In principle, you can reschedule a tutorial before it takes place free of charge. If you cancel a tutorial, the amount of refund depends on when you cancel it. Specifically:

2.1.1 You can book a tutorial online up to 14 days in advance and reschedule it online up to 24 hours before it takes place. If any emergency comes up within 24 hours before the tutorial, and you would like to reschedule it, please write to contact.rachelleslab@gmail.com.

2.1.2 You can cancel a tutorial online up to 24 hours before it takes place and get a full refund.

2.1.3 Cancellation within 24 hours before the scheduled time is considered as short notice, and you will get a 60% refund. Failure to join a tutorial without any notice is also eligible for a 60% refund. Note that rescheduling it within 24 hours before the scheduled time is still free of charge. If you realise you will not be able to join the tutorial on time, and you would like to do it another time instead of cancelling it, please request a reschedule by writing to contact.rachelleslab@gmail.com. No extra cost or penalty will be incurred if the missed tutorial is successfully rescheduled.

2.1.4 Where a tutorial is cancelled by Rachelle's Lab, you will get a full refund.

2.2 Pricing Plans

2.2.1 The pricing plans are non-refundable. You are advised to go for a pricing plan only if you have decided to have regular tutorials at Rachelle's Lab, and if your current schedule allows you to finish the tutorials within the valid period of the chosen plan.

2.2.2 If you purchase a plan, you can book one-hour sessions, two-hour sessions, or a mix of these two types as long as the total tutoring hour does not exceed what is included in the plan.

2.2.3 You can book a tutorial up to 14 days in advance, and you can reschedule it online up to 24 hours before it takes place. If you want to reschedule a session within 24 hours before its scheduled time, please write to contact.rachelleslab@gmail.com and explain the reasons for your short notice. If you fail to join a tutorial without any notice, you cannot reschedule the missed tutorial or get a refund.

2.2.4 If Rachelle's Lab is unable to deliver a tutorial at the scheduled time for any reason, you can reschedule it to any time that is convenient for you, even beyond the valid period of the pricing plan you purchased.

2.3 Translation/Translation Review/Proofreading Services

2.3.1 You must contact Rachelle’s Lab before placing any order for the translation/translation review/proofreading services ("translation services"). The date of delivery must be agreed in writing.

2.3.2 Any order placed without the confirmation of Rachelle's Lab is subject to cancellation. You will get a full refund if you have placed an order without communication beforehand.

2.3.3 If there is any unforeseen interruption in the translator's ability to work at Rachelle's Lab (e.g. illness), your order may be cancelled. The amount of refund depends on how much deliverable work has been finished and is to be determined via negotiation between you and Rachelle's Lab.

2.3.3 If you cancel the order after the translator has started to work on it, you can get a partial refund depending on how much deliverable work has been finished. The detail is to be determined via negotiation between you and Rachelle's Lab.

2.3.4 If Rachelle's Lab misses the agreed deadline of delivery, you will get a 10% refund for each calendar day of delay. Please note that this only applies to the first complete delivery of the translation of the material you initially submit, or, if we set up milestones for the project, the delivery of the last milestone that completes a first draft of the translation of all the material you initially submit.

2.3.5 You may review the complete translation and request revisions of the translation free of charge. This applies to the revision of the translation only (the format, style, specific wording, etc.) and the revision of the translation corresponding to any changes made to up to 10% of the original material. The date of the delivery of the revised translation is to be agreed again in writing.

2.3.6 If you wish to add more material for translation after placing the initial order or make changes to more than 10% of the original material, please write to contact.rachelleslab@gmail.com to discuss the details.

2.4 Customised Service

The terms and conditions stated above do not apply to customised service by default. The cancellation and refund policy may be suject to adjustments depending on the specific content and requirements of each commission and is to be ageed upon between you and Rachelle’s Lab after our discussion of details of the service.

3. Privacy Policy and Cookies

4. Disclaimer

4.1 Rachelle’s Lab has taken every effort and care in preparing the Website. However, Rachelle’s Lab disclaims all warranties, express or implied, as to the accuracy thereof and its fitness for a particular purpose. The content of the Website shall at all times constitute work in progress which may be changed without notice.

4.2 Rachelle’s Lab shall not be liable for any loss or damage arising from your use of or reliance on the Website.

4.3 Links within the Website may lead to other websites. They are provided for convenience only. Rachelle’s Lab is not responsible for any changes to the websites outside rachelleslab.com and all its subdomains or for any loss or damage arising from your use of or reliance on these other websites.

5. Modifications of Terms of Use

Rachelle’s Lab may revise these Terms of Use at any time. The major modifications and updates will be listed on this page, but minor changes may be made without notice. By using the Website and services offered at Rachelle’s Lab you are agreeing to be bound by the then current version of these terms of use.
